TERMS AND CONDITIONS FOR ONLINE SALES

Terms and conditions for the sale of tickets or prepaid cards for events organised by the Toruń Symphony Orchestra

    GENERAL PROVISIONS
  1. Contact details: Toruń Symphony Orchestra (TOS), Aleja Solidarności 1-3, 87-100 Toruń, tel./fax.: +48 56 622 88 05, e-mail: sekretariat@tos.art.pl. The Toruń Symphony Orchestra is financed by Toruń Municipality.
  2. These Terms and Conditions (hereinafter referred to as the ‘Terms and Conditions’) regulate the online sale of tickets for events organized by the Toruń Symphony Orchestra.
  3. The following terms shall have the meanings assigned to them below:
    "Events" - means concerts and other forms of statutory activity organized by the Toruń Symphony Orchestra with the participation of the audience;
    b. "Prepaid card" - means a document that contains the data of the document issuer, an expiry date, and an individual identification mark in the form of a bar code;
            c.  "TOS website" - means the website available at www.tos.art.pl 
            d. “Website for online tickets sales” means the website available at www.biletytos.pl.
  4. By purchasing an event ticket/prepaid card, you accept these Terms and Conditions, commit to their application, and consent to the processing of personal data for the purpose of processing the order.

    ONLINE SALE OF TICKETS AND PREPAID CARDS
  1. The Toruń Symphony Orchestra offers online sales of tickets and prepaid cards.
  2. All prices are given in Polish zloty and include VAT.
  3. Ticket payments are processed by PayPro Spółka Akcyjna, based in Poznań, Poland, at 15 Kanclerska St., 60-327 Poznań. The company is entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda, VIII Economic Department of the National Court Register with the KRS number 0000347935, NIP number 7792369887, with a share capital of PLN 4,500,000.00, fully paid up, entered in the register of national payment institutions kept by the Polish Financial Supervision Authority under the entity number in UKNF IP24/2014. The payment is processed via Przelewy24 Internet system.
  4. PayPro SA Agent Rozliczeniowy is the operator of the payment cards. It is also based at 15 Kanclerska St., 60-327 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda, VIII Economic Department of the National Court Register with the KRS number 0000347935, NIP number 7792369887, Regon number 301345068.
  5. In order to make an online purchase for a ticket or a prepaid card, please:
    ◦ fill out the form with personal information (email, name, phone number and invoice details if required)
    ◦ accept the terms and conditions
    ◦ place the order online
    ◦ pay for the order by wire transfer
    ◦ print the ticket received at the email address.
  6. The order will be considered complete when the TOS confirms payment by the buyer’s bank.
  7. If the buyer’s bank fails to confirm payment within 30 minutes of sending the order online, the order will be automatically cancelled.

    TICKETS AND TICKET TYPES
  1. The TOS offers the following types of tickets for sale online:
    regular tickets,
            b. reduced-price tickets
  2. The terms and conditions for purchasing reduced-price tickets are specified in the Regulations for the Sale of Tickets for Events Organized by the Toruń Symphony Orchestra, which can be found under the Tickets tab at www.tos.art.pl. To enter an event, the ticket holder must present a printed ticket and a document confirming their entitlement to the reduction to the staff.
  3. If purchased online, the ticket for the event will be sent in PDF form to the buyer’s email address and should be printed and presented for entry.
  4. Each ticket allows one-time entry to a specific event.
  5. Tickets are subject to one-time verification before entry. Tickets cannot be reused.
  6. For purchases of more than 10 tickets at a time, please call us for assistance. More information: kasa@tos.art.pl.
  7. VAT invoices are available for online purchases and will be sent to the buyer's email address in PDF form.

    TICKET REFUNDS AND COMPLAINTS
  1. Tickets purchased online are not refundable and it is not possible to exchange them for another ticket, except in the case of event cancellation.
  2. If an event is cancelled, the TOS will refund the payment to the bank account or credit card used for the purchase.
  3. Information about ticket refunds for cancelled events can be obtained by calling (+48) 56 642 43 79 or sending an email to kasa@tos.art.pl.
  4. For complaints, please contact us by email at olszewska@tos.art.pl. The processing of complaints takes up to 7 working days from the date of receipt.

    PREPAID CARD
  1. A prepaid card is a payment method that can be used for online transactions and at the TOS ticket office.
  2. The card can be reloaded with funds multiple times, and the balance can be used for multiple transactions.
  3. The purchase of a prepaid card is confirmed by an accounting note reflecting the turnover of funds. A sales document will only be issued when the card balance is used.
  4. The funds transferred by the card holder become the full property of TOS upon issuance of the Card.

    RULES FOR THE USE OF PREPAID CARDS
  1. The prepaid card is valid for one year from the date of issue. After expiry, any remaining balance on the card will be transferred to TOS account, and the Client cannot request a refund for unused balance.
  2. The prepaid card can be used to purchase tickets for on-site events hosted by TOS only. It cannot be used to purchase tickets for external events.
  3. The prepaid card cannot be exchanged for cash.
  4. The balance of the prepaid card can be checked at the TOS ticket office.
  5. The TOS is not responsible for lost or damaged prepaid cards once they are issued to the User. The execution of a prepaid card constitutes a valid transaction regardless of how the User obtained it.
  6. If the prepaid card is lost or stolen, the User is not entitled to any claims against the TOS except for the option to block the card.
  7. To redeem the prepaid card, the User enters the card's number during the online purchase process. The amount corresponding to the event ticket price will be deducted from the prepaid card.
  8. If the price of tickets or goods exceeds the prepaid card's value, the card balance must be topped up before the purchase can be made using the card.
  9. If the price of tickets or goods is lower than the prepaid card's value, the unused funds remain on the card for future use.

    FINAL PROVISIONS
  1. The TOS reserves the right to cancel a concert, change its date, venue, and time, as well as modify the repertoire (programme or artists) without the obligation to provide reasons for such changes.
  2. The Terms and Conditions shall come into full force and effect on 1 October 2019.

    DATA PROTECTION


 In accordance with the General Data Protection Regulation of 27 April 2016 (GDPR) and the relevant implementing regulations, we hereby inform you that:

  1. Your personal data is controlled by the Toruń Symphony Orchestra, with its registered office in Toruń (87-100), at 1-3 Aleja Solidarności St., Toruń (87-100), NIP (tax ID) 9561429917.
  2. For any matter related to the processing of personal data, you can contact the Data Protection Officer at the email address: iod@tos.art.pl.
  3. Your personal data will be processed for the purpose of reserving tickets and for related communication (Article 6 (1) (f) of GDPR).
  4. Your personal data will only be shared with entities authorized to obtain personal data under the law, as well as entities indirectly involved in communication with you (e.g., IT service providers) and entities that process personal data on behalf of the controller under an agreement on entrusting data processing.
    The Data Controller will make the data available to the payment processing company PayPro S.A. referred to in § 2 item 3 of the Terms and Conditions. PayPro S.A. will process the data for purposes related to the provision of payment services, ensuring compliance with applicable regulations.
  5. Your personal data will be kept for the period necessary to achieve the above purposes.
  6. You have the right to access, rectify, delete, to limit and object to the processing of your personal data.
